Terms and Conditions

Please read these terms and conditions carefully as they contain the legal terms and conditions that you agree to on each occasion when you purchase goods from Cottonwood.

You Are:  Our customer

In this agreement:

 

“Carrier”

Means any person or business contracted by us to carry goods from us to you, whether all or part of the distance.

 

“Goods and Services”

Means any of the goods and services we offer for sale.

 

Our Contract with You

These terms and conditions apply in any event to you as a buyer or prospective buyer of our Goods.

We shall accept your order by e-mail confirmation. Our message will also confirm details of your purchase and tell you when we expect to dispatch your order. That is when our contract is made.

We may change these terms from time to time.

Guarantees are only applicable on items that have been used in a domestic environment and shall not apply when used in a commercial environment.

 

Price & Payment For Delivery

Prices are in South African Rand.

You must pay us the full price of your order before we will send any part of it.

You will pay all sums due to us under these terms by the means specified without any set-off, deduction or counterclaim.

All invoices must be paid within 48 hours of the purchase being made unless specific written permission has been given for a delayed payment.

If invoices are not paid within 48 hours, you will be contacted telephonically or via email and given 24 hours to pay the outstanding balance. Should you fail to pay within this period your order will be cancelled.

 

Your Order

All items in stock have a delivery of time of 2 – 10 working days , once collected by our couriers.

As our reproduction furniture is hand-made the re-order time for goods can be between four and 26 weeks depending on the supplier.

If items are out of stock we require a 20% deposit to secure the goods.

For customised orders we require a 50% deposit.

We aim to be as accurate as we can with delivery estimates but they are not binding. Delays may occur in shipping which we have no control over and we ask our customers to be patient should unforeseen delays occur. All our furniture is handmade and as such, some pieces may vary slightly in colour. Every effort is made to avoid this.

We ask all our customers to check their measurements and access to avoid disappointment.

All bespoke items made to order cannot be cancelled. We will not refund bespoke orders of furniture simply because it does not match, suit or fit or because they are unsuitable to the position the customer envisaged. Each piece is ordered for you and cannot be returned to the manufacturer.

 

Techniqued Furniture

Should a customer require that a piece of furniture be techniqued or repainted to another colour, it is the responsibility of the customer to check that the item has been customised to his/her satisfaction at our warehouse before it is delivered. In the event that the customer is unable to do so, then it is incumbent upon the customer to return the goods to our warehouse at their own cost should any changes be required.

 

Upholstered Furniture

Upholstered furniture such as chairs and beds are guaranteed for 1 year from date of purchase in respect of the frame, craftsmanship and filling.

Should the item be subject to such a manufacturers defect, we will repair or replace it at no charge once it has been returned to Cottonwood. Should the customer have paid a delivery fee, Cottonwood will arrange for a collection and return at no cost to the customer.

Re-upholstery of Furniture

While we do offer a re-upholstery service through a third party, we cannot be held responsible for the quality of the work or for any damage that may have been incurred to the furniture during the re-upholstery process.

 

Ordering errors

We cannot correct ordering errors made by you if ordering off the website. It is your responsibility to check your invoice to ensure that we will be providing the correct items (including finishes).

 

Information You Give Us

You agree that you have provided, and will continue to provide accurate, up to date, and complete information about yourself. We need this information to provide you with the Goods and Services.

 

Delivery & Collection Policy

Purchases can be collected from our store or warehouse if in stock.

We have carefully chosen Courier Companies to deliver the items that you order to you.

Once the product is picked up from us, the Carrier will make deliveries to the address stipulated in your order. Please note that all deliveries are “door to door”. Delivery to a particular room is at the discretion of the person/s doing the delivery based on ease of access. It is the customers’ responsibility that all ordered goods fit into their home and that there are no access issues. You must ensure that someone is present to accept delivery. Please allow 2 to 10 working days for delivery of your order.

Delivery charges

Delivery charges vary depending on the type of products ordered, distance traveled, and Carrier required. These charges cannot be refunded

It is the customer’s responsibility to ensure that all ordered goods fit into the home and that there is no restricted access.

Subject to the other provisions of these conditions we shall not be liable for any direct, indirect or consequential loss (all three of which terms include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and similar loss), costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery, nor shall any delay entitle the customer to terminate or rescind the contract, unless such delay exceeds 180 days.

If for any reason the customer fails to accept delivery of any of the goods when they are delivered we will bring the goods back and charge between R500.00 – R2500.00 for each failed delivery.

Unless we have stated otherwise in writing, delivery dates are not guaranteed, although we shall make every reasonable effort to deliver the goods by any quoted delivery date. We may deliver the goods in installments if the goods are not available at the same time for delivery. All our furniture is delivered by insured furniture couriers.

Damaged goods

Please check your items thoroughly prior to signing for them. If the items are not in perfect condition please do not accept them and contact us for a replacement to be sent.  Once items are signed for we will not be held responsible for any loss or damage whatsoever. Ideally please telephone us straight away and whilst the delivery driver is with you if your item is damaged or broken on 011-244-0045 or 083-777-0237 (after hours) so the item can be returned immediately.

Warranty

All products have a standard 6 Months guarantee which is honoured in the form of parts and labour.

Wood Movement

South Africa, particularly inland areas, has a climate with extreme temperature and humidity variations. This could cause solid wood furniture to move or crack, especially along joins.  This is normally easily fixed with the application of an appropriately coloured wood filler. In the event that you cannot fix this yourself within the 6 month warranty period, you may either take it to our warehouse, or if it was delivered to you, we will collect it from you at no cost to you. If we cannot fix it we will swop out the item at no charge or refund in full.

This guarantee does not extend to normal wear and tear associated with domestic use and natural wood effects or characteristics such as minor cracking and shrinkage and changes in colour with time.

 

Promotions / Sale Items

From time to time we offer promotions to our customers.

Any item purchased prior to a price reduction, either delivered or pending delivery, cannot be reduced. We do not accept returns on sale items.

Goods Returned

We hope that you are happy with your purchase; if however you have ordered the goods over the internet, you may have a right of cancellation. If you do, these are the terms that apply: You must tell us you wish to cancel in writing (email is acceptable) within 7 days of your receipt of the Goods;
In any event, you may not cancel orders for handmade, specially commissioned or personalised goods;

The Goods must be returned to us within 21 days of your telling us you wish to cancel:

  • with both goods and all packaging in their original condition; Please note we will be unable to accept any goods without their original packaging.
  • securely wrapped to prevent damage;
  • including our delivery slip and completed returns form;
  • At your risk and cost. (please let us know if you wish to use our courier service to return goods and we will arrange for this)
  • Any goods purchased in our showroom will be subject to a restocking charge of 20% of the total order value.

After we have received the Goods, we will credit your account with us with the full purchase price of the goods returned no later than 30 days from the date of receipt; if you do not return the Goods to us, you are still liable to us for the cost. Unfortunately, we cannot accept responsibility for returned items lost in the post and recommend that you get a certificate of posting. We are under no obligation to collect or recover Goods from you, but if we do, our costs will be payable by you.

We will not refund ANY returns.

Cancellation

You may not cancel your order after payment has been made. Should you insist on cancellation, then your account will be credited and you may buy other goods in stock.

Disclaimers

Our Content suppliers or we may make improvements or changes to Our Website, the Content, or to any of the Goods and Services, at any time and without advance notice.

You are advised that Content may include technical inaccuracies or typographical errors.

We give no warranty and make no representation, express or implied, as to:

  • The adequacy or appropriateness of the Goods and Services for your purpose.
  • the truth of any information given on Our Website;
  • any implied warranty or condition as to merchantability or fitness of the Goods and Services for a particular purpose;
  • Compatibility of Our Website with your equipment software or telecommunications connection.
  • compliance with any law;
  • Non-infringement of any right.

We are not liable in any circumstances for special, indirect or consequential loss or any damages whatsoever resulting from loss of use, loss of data or loss of revenues or profits, whether in an action of contract, negligence or otherwise, arising out of or in connection with your use of Our Website or the purchase of Goods.
In any claim against us our liability is limited to the value of the goods you have purchased in the contract, which is the subject of the dispute.

 

Contractual Limitation

Where we provide goods or services without specific charge, then it (or they) is deemed to be provided free of charge, and not to be associated with any other service for which a charge is made. Accordingly, there is no contractual or other obligation upon us in respect of any such goods or services.

 

Severability

If any of these terms is at any time held by any jurisdiction to be void, invalid or unenforceable, then it shall be treated as changed or reduced, only to the extent minimally necessary to bring it within the laws of that jurisdiction and to prevent it from being void and it shall be binding in that changed or reduced form. Subject to that, each provision shall be interpreted as severable and shall not in any way affect any other of these terms.

 

No Waiver

No waiver by us, in exercising any right, power or provision hereunder shall operate as a waiver of any other right or of that same right at a future time; nor shall any delay in exercise of any power or right be interpreted as a waiver.
